In January 30, 2012, the Philippine Senate approved the final reading of the Senate Bill No. 2793, otherwise known as the "Cybercrime Prevention Act of 2012”.

Cybercrime refers to the misuse, abuse and illegal access of computer information or data. The "Cybercrime Prevention Act of 2012” is promulgated to effectively fight and prevent such kind of offenses at domestic and international levels.

Cybercrime Offenses

Under the "Cybercrime Prevention Act of 2012”, the following acts are considered cybercrime offenses which are punishable by law:

A.  Offenses against the confidentiality, integrity, and availability of computer data and systems
  1. illegal access of computer system
  2. illegal interception of any non-public transmission of computer data to, from or within a computer system
  3. data interference
  4. system interference
  5. misuse of devices such as computer program, computer password, access code or similar data (the illegal use, possession, production, sale, procurement, importation, distribution of the said devices)
B.  Computer-related offenses
  1. Computer-related forgery
  2. Computer-related fraud
C.  Content-related offenses
  1. Cybersex
  2. Child pornography
  3. Unsolicited commercial communications
D.  Aiding or abetting in the commission of cybercrime

E.  Attempt in the commission of cybercrime

Penalties/Punishment of the Cybercrime Offenses

Any person found guilty of any of the A and B cybercrime offenses shall be punished with imprisonment of prision mayor or a fine of at least PhP200,000.00 up to a maximum amount depending to the damage incurred or depending on the court.

Cybersex criminals shall be punished with prision mayor or a fine of at least PhP200,000.00 but not exceeding PhP1,000,000.00 or both.

Those who are found guilty of child pornography shall be punished with the penalties enumerate in Anti-Child Pornography Act of 2009.

Any person found guilty of unsolicited commercial communications shall be punished with imprisonment of arresto mayor or a fine of at least PhP50,000.00 but not exceeding PhP250,000.00 or both.

Any person found guilty of aiding and attempt in the commission of cybercrime shall be punished with imprisonment one degree lower than that of the prescribed penalty for the offense of a fine of at least PhP100,000.00 but not exceeding PhP500,000.00 or both.

If the cybercrime offense is knowingly committed on behalf of or for the advantage of a person in a company, corporation or organization, that person shall be punished with a fine up to maximum of (PhP10,000,000.00).

Bureau of Immigration denies Arroyo couple's bid to leave

MANILA, Philippines — The Supreme Court (SC), in an 8-5 vote, issued Wednesday a temporary restraining order (TRO) on the watch list order (WLO) issued against former President and now Pampanga Rep. Gloria Macapagal Arroyo, her husband former First Gentleman Jose Miguel T. Arroyo, and others facing investigation on the alleged poll fraud in the 2004 and 2007 elections in Mindanao.
But the SC imposed three conditions for the former First Couple to avail themselves of the TRO, according to SC Spokesman and Court Administrator Jose Midas P. Marquez.

First, they have to post a cash bond of P2 million.

Second, they should appoint their lawyers to receive in their behalf all the processes or subpoenas that may be issued by the DoJ in the poll fraud cases or the Office of the Ombudsman in the plunder complaints involving Mrs. Arroyo.

Third, they should report to the Philippine consular offices or embassies in the countries they would be travelling.
The SC order allowed Mrs. Arroyo to seek medical treatment abroad.
Arroyos held at NAIA

However, after the Arroyos posted the P2-million cash bond to comply with the SC requirement, the former First Couple tried to leave but their attempt was foiled when Bureau of Immigration (BI) agents held them at the Ninoy Aquino International Airport (NAIA), citing the order of Justice Secretary Leila de Lima’s order for the BI to continue enforcing the watch list order.

Arroyo ally, Minority Leader Edcel Lagman, said that when the camp of Arroyo asked for De Lima’s order, BI agents could not show any.
Lawyer Ferdinand Topacio, the lawer appointed by the Arroyo couple to represent them based on the second condition set by the SC, said De Lima will have to answer for defying the SC.

How the Justices voted

According to Marquez, the eight justices who voted to issue the TRO were Chief Justice Renato C. Corona and Justices Presbitero J. Velasco Jr., Arturo D. Brion, Diosdado M. Peralta, Lucas P. Bersamin, Roberto A. Abad, Martin S. Villarama Jr., and Jose Portugal Perez.

He said that those who voted to deny the TRO and opted to hear first the position of the government, through the DoJ, were Senior Justice Antonio T. Carpio and Justices Jose Catral Mendoza, Maria Lourdes P. Sereno, Bienvenido L. Reyes Jr., and Estela Perlas Bernabe.
Justice Teresita J. Leonardo-de Castro is on official trip abroad, while Justice Mariano C. del Castillo is on a wellness leave.

Marquez said the SC set oral arguments on the consolidated cases filed by the former First Couple on November 22. The DoJ was directed to file its comment on the two petitions.

Marquez said the justices who voted to issue a TRO believed that the inclusion of the former First Couple in the DoJ’s WLO “might probably work as an injustice to them without any case being filed against them in court.”

“The issuance of the TRO is consistent with the constitutional presumption of innocence until proven guilty,” he said.

He pointed out that the TRO was addressed only to the DoJ and the Bureau of Immigration (BI) and “not to any court.”

Under the rules, a TRO issued by the SC is indefinite. But it could be lifted anytime if circumstances warrant like a case against the Arroyos is filed in court and that court issues a hold-departure order (HDO) against them. The filing of a case in court and the issuance of an HDO must be manifested before the SC to warrant the lifting of the TRO.

The DoJ, which was the main respondent in the petitions filed by the Arroyos, can file a motion to lift TRO. The lifting depends on the sound discretion of the SC. But SC records showed that the High Court seldom lifts its TRO pending resolution of the case on its merits.

Senators welcome ruling

Sen. Joker Arroyo said he is pleased that the SC decided to allow the former President to leave the country to seek medical attention abroad.
At the very least, the High Court, which is the last bastion of democracy in the country, has managed to put a brake on the Aquino administration’s “totalitarian tendencies.”

“My point here is this: the SC has put a stop, put a brake, on the totalitarian tendencies of this government. We already have a creeping martial law here that we don’t only notice,” Arroyo said when asked by reporters.

Senator Miriam Defensor Santiago commended the SC for issuing the TRO.

“The Supreme Court did a good job, that is an exhibition of judicial sagacity and sobriety,” said Sen Santiago.

“The right to travel is a fundamental right that should not be impaired by anyone no matter how powerful they maybe because it is a constitutionally protected right,” said Santiago, who from the very start said that banning Mrs. Arroyo to travel is unconstitutional
Sen. Francis Escudero said he finds the SC decision “fair and reasonable.”

“The decision of the Supreme Court is fair and reasonable. While I believe that former President Arroyo has to answer for a lot of things, she should be made to do so under the proper constitutional processes,” Escudero said.


While acknowledging the Arroyos right to travel, Senate President Pro Tempore “Jinggoy” Estrada still said he fears the couple would never return once they leave the country.

Estrada and Sen. Franklin Drilon said it is high time state prosecutors file a strong case against the Arroyos so a formal hold departure order (HDO) can be issued against the couple.

“I’m not surprised by (the SC’s decision). They tested the limits of her (Secretary De Lima’s) power. She tested the limits of the presidential power, the power of the Executive branch, but at the end of the day it is the SC that will decide what are the limits,” Drilon said.

“The only remedy left is for them to file cases now. They should file a criminal case that is supported by evidence before the proper courts para maka-release na ng HDO,” added Drilon.


Sen. Panfilo Lacson said De Lima mishandled the case because jurisprudence states that it is only the courts that can prohibit a citizen from traveling abroad.

Although he is not a lawyer, Lacson refuted De Lima’s stand that national interest prevails over the Constitution, particularly on the constitutional right of the Arroyos to travel.

“That is a wrong proposition,” Lacson said, indirectly stating that it is the other way around.

Lacson stressed that De Lima should have studied case carefully, particularly on constitutional issues before she acts.

The Arroyos had to go to the SC after Mrs. Arroyo’s request for an allow departure order (ADO) was denied by De Lima.

The Arroyos, in their petitions, also pleaded the SC to resolve, once and for all, the constitutionality of the WLOs issued by the DoJ.

Earlier, government lawyers had opposed the plea for a TRO made by the Arroyos on their two petitions.

In two urgent manifestations filed by Solicitor General Jose Anselmo Cadiz, the SC was asked to give the government reasonable time to respond to the two petitions filed by the Arroyos, to deny the plea for TRO, and to hold oral arguments on the cases.

In seeking the nullification of the WLO, the former President said she would suffer irreparable injury if the implementation of the WLO issued against her is not nullified immediately.

“The inability of petitioner GMA to leave for abroad to alleviate, or, at least, prevent the aggravation of her hypoparathyroidism and metabolic bone disorder has given rise to the danger that the said conditions afflicting petitioner GMA may become permanent and incurable,” Mrs. Arroyo said in a petition filed by former Justice Minister and Solicitor General Estelito P. Mendoza.

“Having been immobilized by a debilitating condition for the last few months, and having been subject to long operations and their complications, she seeks other experts’ perspective and to receive optimum care to ensure that she will not be disabled for the rest of her life and that her recovery will no longer be impeded by complications, which she has unfortunately experienced for the last few months,” the petition also stated.

In his petition, Mr. Arroyo told the SC the issuance of a WLO against him constitutes a violation of his freedom of movement and his right to travel.

But former President Joseph Estrada said that more than former President Arroyo’s “constitutional right to travel is her constitutional right to stay in the country.”

“The Supreme Court made a decision based on a debate on rights but they (Justices) should have also considered the importance of one’s duty as a public official,” Estrada said.


Last August 23, the SC stopped the DoJ from implementing the first WLO issued on August 4 against Mr. Arroyo on request of the Senate Blue Ribbon Committee in its investigation into the acquisition by the Philippine National Police (PNP) in 2009 of alleged second-hand helicopters reportedly owned by the former First Gentleman.

In stopping the implementation of the August 4 WLO, the SC – in a unanimous vote – ruled that the WLO issued against Mr. Arroyo “violates his constitutional right to travel.”

Section 6, Article III of the Constitution provides that the “right to travel shall not be impaired except in the interest of national security, public safety and public health, as may be provided by law.” (With reports from Genalyn D. In a dramatic airport showdown, President Benigno Aquino III’s government stopped former President Gloria Macapagal-Arroyo and her husband Jose Miguel “Mike” Arroyo from boarding a Hong Kong-bound plane and leaving the country Tuesday night, despite a Supreme Court order allowing her to seek medical treatment abroad.

The wheelchair-bound Arroyo, wearing a neck brace, and her husband were supposed to take a Dragon Air flight leaving for Hong Kong at 8:50 p.m. but immigration officials barred them from taking the flight.

The Arroyos had also booked other flights, including Singapore Airlines, but immigration officials stopped them from getting on any of the planes.

Arroyo’s lawyer, Ferdinand Topacio, said they would file contempt charges Wednesday against Justice Secretary Leila de Lima and others who stopped the Arroyos from leaving.

Asked if the decision of the Bureau of Immigration to stop the Arroyos from leaving despite a high court order giving the Arroyos the green light amounted to a contemptuous act, Supreme Court spokesperson Jose Midas Marquez said: “Yes, it is, but we still have to look at the facts.”

Prior to the Arroyos’ arrival at the airport, Lina Pelia, chief of the Bureau of Immigration’s airport operations center, told the Philippine Daily Inquirer that she would heed De Lima’s order to stop the Arroyos from leaving.

Arroyo, now a congresswoman of Pampanga, and her husband arrived at the Ninoy Aquino International Airport (Naia) Terminal 1 on a St. Luke’s Medical Center ambulance.

Amid a mob of jostling mediamen, Arroyo was helped off the ambulance by her husband, her son and congressman Juan Miguel “Mikey” Arroyo, spokesperson Elena Bautista-Horn and several nurses.

It took several attempts for Arroyo to get off the ambulance as her guards tried to control onlookers and media people swarming around to come closer to the former President.

“Maawa naman kayo (Have pity)!” some of her aides shouted.

Earlier Tuesday, Marquez warned De Lima and other government officials that they “might be held for contempt” if they insisted on preventing the Arroyos from leaving in defiance of the court’s restraining order.

“As we have seen in the past, once the TRO (temporary restraining order issued by the high court) is released, it takes effect immediately. We have to understand that TROs are just a provisional remedy for the time being,” Marquez told the Inquirer.

De Lima: TRO deferred

Speaking at a hastily called news conference at the Palace late Tuesday afternoon, De Lima said: “In the event the Arroyos appear at the airport and other ports of exit between now and up to the resolution of our motion for reconsideration, [authorities] need to bar them from leaving. The TRO is being stayed or deferred until the resolution of [our] motion for reconsideration.

“We need to do this because of confirmed information and reports” from Ninoy Aquino International Airport (Naia) and Bureau of Immigration (BI) “that there were bookings made [Tuesday].”

De Lima said Arroyo had booked passage on Philippine Airlines’ Flight PR501 and Singapore Airlines’ Flight SQ919 for 4 p.m. and 5 p.m. Tuesday but that these were canceled because she did not show up.

“There is an intention to leave the country immediately, and that is puzzling to us,” De Lima said.

There were supposedly two other bookings made for Singapore—PR505 and SQ921 leaving at 7:35 p.m. and 7:55 p.m. respectively—and a Dragon Air flight at 8:30 p.m. An Inquirer source said the last flight was bound for Hong Kong.

First plane out

The Arroyos apparently could not wait to leave.

Another source said that hours before the Supreme Court began its en banc session to tackle the couple’s petition to lift the travel ban on them, Mike Arroyo confided to certain reporters that he and his wife would take the first plane out as soon as the tribunal handed down its decision.

The source said the Arroyos had anticipated a favorable decision from the high court and made the two bookings with PAL.

Shortly before the high court released the TRO, House Majority Leader Neptali Gonzales said the Aquino administration could choose to defy the tribunal and make it difficult for the former first couple to leave the country, perhaps by ordering the BI not to sign their papers.

“You cannot ride an airplane if you have no clearance from immigration,” he said at the Ugnayan sa Batasan forum.

Gonzales, however, said this course would entail a lot of risk because the international community might consider it a form of political persecution.

“The executive can risk it and have a next round of legal actions where it could be sued for contempt of court,” he said.

Asked if De Lima’s order that the Arroyos be stopped from leaving was an act of contempt, Marquez said: “Let’s see. I don’t think there is defiance yet.

“Maybe they were just surprised with what happened because they fought against it. But now that there’s already a TRO, it’s effective immediately.

“I am hoping out that our government officials will comply [with], observe and respect the TRO.”

De Lima said that as far as Malacañang was concerned, the Department of Justice’s inclusion of the Arroyos in the watch list remained in effect because it had not yet received a copy of the TRO, which would pave the way for its filing of a motion for reconsideration at the high court.

“The reported TRO has not been substantiated to exist pending receipt of respondents or the Solicitor General. Hence, it’s the status quo. The existence of the watch list order against the Arroyos remains,” she said.

De Lima said this was why she issued the directive to the BI and called on Transportation Secretary Manuel “Mar” Roxas II to order civil aviation authorities to stop the Arroyos and their “entourage” from leaving the country.

She said she had also directed the Philippine National Police and the National Bureau of Investigation to be on the lookout for any attempt of the Arroyos to slip out.

De Lima rushed to the Palace for a meeting with President Aquino after the high court issued the TRO shortly past noon.

She said that during the meeting, the President told her “to do what’s necessary under the premises and under existing circumstances,” and that her directives were in accordance with what she “deemed appropriate.”

Asked about the President’s reaction to the high court decision, she said: “I can say he is dismayed, he is frustrated.”

De Lima said Malacañang’s move was “defensible.”

Net effect

“The TRO cannot bind us if we are not yet of official receipt of [it]. It’s our right to avail [ourselves] of the proper remedy—the motion for reconsideration,” she said.

Commenting on the high court’s TRO, De Lima said the Supreme Court had “effectively” decided that the watch list order was unconstitutional.

“That is the net effect. If [the Arroyos] would be able to leave because of the TRO, what will be our remedy now?” she said.

The justice secretary also questioned Marquez’s statement that the Arroyos were required to post a cash bond, appoint legal representatives, and report to embassies abroad.

“Are those guarantees?” she said.

Mr. Aquino’s spokesperson Edwin Lacierda said the high court’s issuance of a TRO was “unfortunate.”

“It was a decision that we are not hoping for,” Lacierda said. “We were hoping for the best and expecting the worst.”

Told that representatives of the party-list group Bayan Muna had blamed Malacañang for its current predicament because it was slow in filing charges against the Arroyos, Lacierda said the President had directed his officials to observe due process for people being investigated.

‘As soon as possible’

According to Topacio, the former first couple immediately booked a flight to Singapore moments after the Supreme Court issued the TRO.

He said the Arroyo couple were to see medical experts in Singapore and Spain to seek treatment for the former President’s bone disease.

“They are leaving as soon as possible, not for anything else but the former President’s treatment,” Topacio told the Inquirer.

“There’s really an absolute necessity for [her] to be given immediate medical attention for her condition,” he said.

Topacio said that the three conditions set by the high tribunal were “reasonable enough,” and that he had advised his client to comply.

Dousing suspicion that the Arroyos had no intention to return, he said: “I assure the Filipino people that my client would return to the Philippines and face the accusations against him.

“We believe that the court would eventually absolve my client.”

In a statement, Mike Arroyo said the tribunal’s decision to grant his and his wife’s petition was “a triumph of the force of law against the law of force.”

He described the Aquino administration as “despotic.”

“Once again, the Supreme Court has proven itself as the bulwark of the people’s civil and political rights as against the encroachment of the vast powers of the executive,” he said.

In a text message to the Inquirer, Roxas said he had ordered airport and other air travel authorities to comply with De Lima’s directive.

Please pray for my Brother who passed away October 21 2011. He had recently turned 29, however, his death was not expected. Dear God,

I know it is not worth my cry for long hours. I can't afford the CT-Scan for my brother. I do not know what to do. As a new day, He can't breathe easily. My parents can't give mental medicine last night since he is suffering from it. The doctors give us an order but we make letter.

God, Please save my brother. I am looking for urgent solution for this. also please help us to enlighten some people who surrounds on us.

My male sibling got some fatal problems for more than 2 years and i provide all the needs for him.

 

Last Monday, We called an ambulance and went to hospital. He examine for almost 48hours. Unfortunately, Doctor ask us to transfer from Hospital #1 to Hospital #2 for some other exams that not part of Hospital #1.

 

Yesterday in Hospital #2, They ask me to have my sibling's X-RAY. they gave many x-ray requests but we can't afford it. So, We already got 2 x-rays and few tests completed.

 

after an X-Ray, the doctor requests to have urgent CT-scan but it's too pricey.

 

So the doctors make some letter that states that we cannot make CT Scan due of financial problem. if there any symptoms, It's our own risk.

 

We go back my sibling to our home.

Today, we talked and he said: "Huwag ninyo po ako pababayaan"

Then I checked my facebook account for confirming this email.

I was shocked and thinking. How can I post some pornographic or related content if I just added a new blog post few hours ago regarding Shamcey Supsup with her swimwear photo in Miss Universe pageant? or my perfumes added in my wall? Please nourish my mind. I don't see any adult material in my previous post wall, photos, videos within my profile account.

In ABS-ACBN new's article, Shamcey Supsup  expose the source of name for her trademark strut during the recent Miss Universe pageant. In an exclusive interview with Korina Sanchez on "TV Patrol" Friday. 

Supsup Said:“It was like a mix of all the training that I had.”“But the term came from a friend, a Spanish friend, and he doesn’t know how to speak English and ‘yun ang lagi niyang sinasabi, ‘walk like a tsunami,’” she said.According to Supsup, the ‘tsunami walk’ is a way of describing her strut down the pageant stage that sought to “blow away” the judges.

Upon her arrival in the Philippines a few days ago (fresh from winning third-runner-up at Miss Universe), Shamcey was warmly welcomed by her fellow “kababayans” in a dashing motorcade arrival from the airport. She denied she had plans of joining showbusinesss, as she declared that being a part of Philippine acting and performing business is not her priority at this time. But rumours still persist that Shamcey is being offered by the Kapamilya network to be a part of the roster of talents of ABS-CBN channel 2.

PLEASE REPOST THIS FOR EVERYONE'S SAFETY.

 

It was about 3 weeks ago, I was at the Shell station getting diesel. It was about 11:30pm .. I was approached by 2 men and 2 women in a car. The man that was driving asked me 'What kind of perfume do you wear?' I was a bit confused and I asked him 'Why?' He said 'We are selling some name brand perfumes, at cheap prices.' I said I had no money. He then reached out of the car and handed me paper that was laminated; it had many perfumes on it. I looked quickly at it and gave it back. I said, I have no money. He said it is OK, we take cheques, cash or credit cards. Then the people in the car began to laugh. I just got in my car and said no thanks. Then I received this e-mail yesterday and it sent chills up my spine. Please read this. It is not joke. Here is the e-mail I was sent:

Our world seems to be getting crazier by the day. Pipe bombs in mailboxes and sickos in parking lots with perfume. Be careful. I was approached yesterday afternoon around 3:30 pm in a car park by two males who asked what kind of perfume I was wearing. Then they asked if I'd like to sample some fabulous scent they were willing to sell me at a very reasonable rate. I probably would have agreed had I not received an e-mail some weeks ago warning of a 'Wanna smell this neat perfume?'scam. Someone walks up to you at the malls or in parking lots and asking you to SNIFF PERFUME that they are selling at a cheap price. THIS IS NOT PERFUME...IT IS ETHER! When you sniff it, you'll pass out. They'll take your wallet, your valuables and heaven knows what else. The men continued to stand between parked cars, I guess to wait for someone else to hit on. I stopped a lady going towards them, pointing at them and told her about how I was sent an e-mail at work. If it were not for this e-mail, I probably would have sniffed the 'perfume' but thanks to the generosity of an e-mailing friend, I was spared whatever might have happened to me. I wanted to do the same for you..

Judge Vivica A. Fox asked Miss Philippines if she would change her religion to marry someone she loves. Shamcey answered no.

Money Request Hacking scheme on Paypal accoiunt

This Hacker doesn’t want to leave my PayPal account. Few minutes ago, I tried to access my PayPal account and surprised that I can’t access it so I better to change my login credentials.

After changing and logging in to my account, another surprised comes in. The Hacker sends request money/payment worth USD50.00 per transaction to PayPal users last September 6 2011.
 

Since my PayPal account is limited and can’t withdraw or transfer money but can receive payments. I am very disappointed to PayPal for being limited without removing the email addresses that hacker added on my account. Adding email address on PayPal account can receive notification emails on your account’s activity and also changed password once an authorized user like Hackers knows your credit card number, Security Question Answers and more…

Even trying to contact them and telling this situation, they always send me automated response and “PayPal appeal denied” email messages. Now, I cancelled those payment requests and hoping PayPal will hear my side and receive a kind response with them.

NOTE: This incident is not connected with any transaction from Merkado Network (http://www.merkadonetwork.com). The hacker “directly” logged in to my PayPal account and did such criminal actions.
